Terms of Service

The App Chicks is a trade name of BEYONDtrading, LLC, a Nevada limited liability company. We design, build, ship, and maintain software products — primarily mobile and web applications — delivering a white-glove client experience led by a dedicated human project owner, supported by modern development tooling behind the scenes.

Some features of the Service require an account. You agree to provide accurate information, keep your credentials confidential, and notify us promptly of any unauthorized use of your account. You are responsible for all activity under your account.

If you engage The App Chicks to build an application or deliver a service (the “Hatchery”), the specific scope, deliverables, fees, and timelines are governed by a separate Statement of Work (“SOW”) or engagement agreement. In case of conflict between these Terms and an SOW, the SOW controls for that engagement.

Deliverables, intellectual property ownership, and licensing are defined per engagement. Unless otherwise specified in the SOW, The App Chicks retains the right to reuse generic tools, frameworks, and patterns developed during an engagement.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law.
• Attempt to gain unauthorized access to any part of the Service or the accounts of others.
• Interfere with, disrupt, or disable the Service or its infrastructure.
• Use the Service to transmit malicious code, spam, or abusive content.
• Reverse engineer, decompile, or extract source code from our hosted applications except as permitted by law.

Fees for client engagements are set in the applicable SOW. Invoices are payable according to the terms stated on the invoice. Late payments may accrue interest at 1.5% per month or the maximum rate allowed by law, whichever is lower.

Each party agrees to keep confidential the non-public information shared by the other party during the engagement. Obligations of confidentiality survive termination of the engagement for three (3) years.

We warrant that services will be performed with reasonable skill and care. Except for this express warranty, THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL The App Chicks OR BEYONDtrading, LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICE. OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE FEES PAID TO US UNDER THE APPLICABLE SOW IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Either party may terminate an engagement according to the terms of the applicable SOW. We reserve the right to suspend or terminate accounts that violate these Terms or engage in abusive behavior.

These Terms are governed by the laws of the State of Nevada, United States, without regard to its conflict-of-laws principles. Any dispute arising out of these Terms shall be resolved in the state or federal courts located in Clark County, Nevada.

We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice on the Service. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
